TERMS AND CONDITIONS

(Peru Ayahuasca Retreat)

Please read the following Terms and Conditions carefully. These Terms and Conditions apply to your booking with Soul Room Sacred Journeys Ltd (“we”, “us”, “our”). By making a booking and paying your deposit, you irrevocably agree to enter a binding contract with us under these Terms and Conditions. This contract becomes effective immediately upon our written confirmation of your booking.

 

1. PRICES

All advertised retreat prices are subject to availability and may be varied or withdrawn at any time prior to booking confirmation and payment of the deposit. Prices are quoted in New Zealand Dollars (NZD) unless otherwise stated. We reserve the right to increase prices before full payment is made to reflect changes in costs beyond our reasonable control, which may include but are not limited to fluctuations in exchange rates, government levies, taxes, accommodation, transport, or third-party supplier costs. Once your booking has been paid in full, your price is locked and will not change.

 

2. CANCELLATION, DATES, AND VENUES

We reserve the right to cancel or reschedule any retreat up to sixty-one (61) days prior to the scheduled retreat start date. In this case, you will receive a full refund of any payments made, less any bank or payment processing fees. We will not be liable for any additional costs or losses incurred by you as a result of cancellation, including but not limited to airfares, visas, vaccinations, insurance excesses, or non-refundable flights. We will make every reasonable effort to deliver the retreat as advertised, but we reserve the right to change or substitute venues, facilitators, accommodation, schedules, or activities at any time where necessary for safety, environmental, or logistical reasons. Should the new arrangements not suit you, a credit note will be issued in accordance with Clause 6. Cash refunds will not be issued except where required by law.

 

3. FORCE MAJEURE

We are not liable for any delay or failure in performing our obligations due to events or circumstances beyond our reasonable control. Such circumstances (“Force Majeure Events”) include, but are not limited to, natural disasters, war, terrorism, pandemics, civil unrest, strikes, government restrictions, or other events that render performance of our obligations unsafe, impractical, or impossible. In the event of a Force Majeure, we may, at our sole discretion, cancel or postpone the retreat and refund any recoverable funds, less deposits and non-recoverable costs incurred on your behalf.

 

4. PAYMENT

A non-refundable deposit is required to secure your place on the retreat. Payment of the deposit signifies your acceptance of these Terms and Conditions. The remaining balance of your retreat fee must be paid no later than forty-five (45) days prior to the retreat start date. Bookings made within forty-five (45) days of the retreat commencement must be paid in full at the time of booking. Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of your deposit.

 

5. CANCELLATION BY PARTICIPANT

All cancellations must be received in writing. Deposits are strictly non-refundable. If you cancel more than sixty (60) days before the retreat start date, fifty percent (50%) of the balance payment will be retained as a cancellation fee. If you cancel less than sixty (60) days before the retreat start date, one hundred percent (100%) of the balance payment will be retained. No refunds will be issued once the retreat has commenced, for non-attendance, or for early departure. You are strongly advised to obtain comprehensive cancellation insurance at the time of booking.

 

6. CREDIT NOTES

If a credit note is issued under these Terms, it will be valid for twelve (12) months from the date of issue. Credit notes are not transferable to other persons and cannot be exchanged for cash. Any unused balance will expire at the end of the validity period.

 

7. TRAVEL INSURANCE

All participants must hold comprehensive travel insurance that covers all travel dates and destinations, including remote jungle regions. Your insurance must include, at a minimum, medical coverage, emergency evacuation, repatriation, trip interruption, personal liability, and loss of luggage or personal items. We strongly recommend that your insurance also cover retreat cancellation, curtailment, delays, and any medical costs arising from participation in Ayahuasca or other plant medicine ceremonies. You will be required to provide proof of valid travel insurance before departure. Failure to do so may result in cancellation of your booking without refund. Soul Room Sacred Journeys Ltd will not be responsible for any losses or costs arising from your failure to obtain adequate insurance.

 

8. HEALTH, SAFETY, AND AYAHUASCA PARTICIPATION

Participation in this retreat involves travel to remote jungle regions of Peru and participation in Ayahuasca ceremonies facilitated by qualified local healers (Curanderos). By booking, you acknowledge and accept that: Participation in Ayahuasca and other plant medicine ceremonies involves inherent physical, psychological, and emotional risks. You must truthfully disclose all existing physical, mental, or emotional health conditions, medications, and relevant history prior to the retreat. Certain medical conditions and pharmaceutical medications (including but not limited to antidepressants, MAO inhibitors, antipsychotics, and heart medications) are contraindicated with Ayahuasca. We may require you to provide a doctor’s letter confirming your fitness to participate. You participate voluntarily, with full knowledge of the potential risks, and are solely responsible for your health and wellbeing throughout the retreat. Sacred Journeys Ltd and its facilitators are not medical practitioners and do not provide medical care, diagnosis, or treatment.

We reserve the right to deny participation in any ceremony or activity if, in our judgment or that of the facilitators, your participation may endanger yourself or others. No refunds will be given in such cases.

 

9. ACCEPTANCE OF RISK

You acknowledge that travel in remote jungle environments, transportation by local means, participation in ceremonial activities, and exposure to natural elements involve inherent risks, including but not limited to illness, infection, insect-borne disease, wildlife encounters, physical injury, psychological distress, or death. You voluntarily assume all such risks, whether known or unknown, and agree that Sacred Journeys Ltd shall not be liable for any loss, injury, damage, delay, or expense arising from your participation in the retreat or related travel.

 

10. INDEMNITY AND WAIVER OF LIABILITY

To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Soul Room Sacred Journeys Ltd, its directors, employees, facilitators, contractors, and agents from and against any and all claims, actions, losses, damages, or expenses (including legal fees) arising from: Participation in Ayahuasca or other plant medicine ceremonies; Participation in yoga, meditation, or physical activities; Travel to or within remote regions; or Any act, omission, or negligence by third-party providers. You expressly waive any claim against Soul Room Sacred Journeys Ltd for consequential, indirect, or punitive damages, and understand that participation is entirely voluntary and undertaken at your own risk.

 

11. THIRD-PARTY PROVIDERS

We work in cooperation with local facilitators, shamans, transport providers, and accommodation operators (collectively, “Third-Party Providers”). These entities are independent contractors and not employees or agents of Soul Room Sacred Journeys Ltd. While we take reasonable care to partner with reputable providers, we are not responsible for their acts, omissions, negligence, or conduct. Services provided by Third-Party Providers may be subject to their own terms and conditions, which you agree to accept as a condition of participation.

 

12. PASSPORTS, VISAS, AND ENTRY REQUIREMENTS

It is your responsibility to ensure you hold valid passports, visas, and any other required documentation for travel to Peru. Your passport must be valid for at least six (6) months beyond your intended date of departure from Peru. We accept no liability for refusal of entry, detainment, deportation, or additional costs incurred due to your failure to comply with immigration requirements.

 

13. EARLY RETURN, ILLNESS, OR NON-PARTICIPATION

If you choose to leave the retreat early for any reason, including illness, personal circumstances, or behavioral issues, you will not be entitled to any refund or credit for unused services. You are responsible for all costs associated with early departure, including transportation, accommodation, and medical care. No refunds will be made for missed meals, activities, or ceremonies.

 

14. PROGRAM VARIATION

We reserve the right to modify or substitute facilitators, ceremonies, teachers, or activities where necessary to ensure the safety and wellbeing of participants or to comply with local regulations or environmental conditions. All changes will be communicated as soon as reasonably possible.

 

15. PRIVACY AND MEDIA CONSENT

By participating in the retreat, you consent to the collection, storage, and use of your personal information by Soul Room Sacred Journeys Ltd for the purpose of managing your booking and conducting the retreat. You also acknowledge that photographs, video, and audio recordings may be taken during the retreat for promotional, educational, or archival purposes. By attending, you grant Sacred Journeys Ltd a perpetual, worldwide, royalty-free license to use such media in marketing and communications. You may opt out of photography or filming by providing written notice prior to the retreat.

 

16. GOVERNING LAW

These Terms and Conditions are governed by the laws of New Zealand, and both parties submit to the exclusive jurisdiction of the New Zealand courts.

 

17. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

 

18. INTEGRATION AND VARIATION

These Terms and Conditions constitute the entire agreement between you and Soul Room Sacred Journeys Ltd and supersede all prior agreements or representations. We may update or vary these Terms from time to time by written notice to you, and such variations shall apply to all bookings made thereafter.

 

ACKNOWLEDGEMENT OF UNDERSTANDING

By making a booking, paying a deposit, or attending the retreat, you acknowledge that you have read and fully understood these Terms and Conditions, accept all risks associated with participation, and voluntarily agree to be bound by them.
