TERMS AND CONDITIONS 

(Rishikesh & Himalayan Yoga and Meditation Retreat)

Please read these Terms and Conditions carefully before booking. These Terms and Conditions form a binding agreement between you (“the Participant”) and Soul Room Sacred Journeys Ltd, registered in New Zealand (“we”, “us”, “our”). By submitting a booking form, paying a deposit, or attending the retreat, you confirm that you have read, understood, and agreed to all terms outlined below.

 

1. PRICES

All retreat prices are quoted in New Zealand Dollars (NZD) unless otherwise specified. Prices are subject to change without notice until a deposit is received and your booking is confirmed. We reserve the right to adjust pricing due to fluctuations in exchange rates, accommodation costs, transport fees, or government taxes beyond our control. Once full payment has been received, the price is fixed.

 

2. CANCELLATION, DATES, AND VENUES

We reserve the right to cancel or postpone a retreat up to sixty-one (61) days prior to commencement. If cancellation occurs, you will receive a full refund of payments made, less any unrecoverable bank or administrative fees. We will not be held liable for other costs or losses, such as flights, visas, insurance excess, or vaccinations. We will make every reasonable effort to deliver the retreat as advertised; however, itineraries, venues, or facilitators may be modified in response to logistical needs, local conditions, or weather. Should the revised arrangement not suit you, a credit note will be issued in accordance with Clause 6.

 

3. FORCE MAJEURE

Soul Room Sacred Journeys Ltd is not responsible for delays, alterations, or cancellations due to circumstances beyond our reasonable control, including but not limited to natural disasters, floods, political unrest, strikes, pandemics, or acts of government. If such circumstances occur, we may cancel or postpone the retreat and refund any recoverable funds, less non-refundable deposits or supplier costs already paid.

 

4. PAYMENT

A non-refundable deposit is required to confirm your place. Payment of the deposit constitutes full acceptance of these Terms and Conditions.

The remaining balance must be paid no later than 45 days before the retreat start date. Bookings made within 45 days of commencement require immediate full payment. Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of your deposit.

 

5. CANCELLATION BY PARTICIPANT

All cancellations must be made in writing. More than 60 days before retreat start — 50% refund of any payments made (excluding deposit). Less than 60 days before retreat start — no refund. Deposits are strictly non-refundable under any circumstances. No refunds or credits will be given once the retreat has begun or if the participant fails to attend scheduled activities.

 

6. CREDIT NOTES

If a credit note is issued, it will be valid for 12 months from the date of issue. Credit notes are non-transferable and non-redeemable for cash.

 

7. TRAVEL INSURANCE

All participants must obtain comprehensive travel insurance covering: medical emergencies, trip interruption, evacuation, repatriation, loss of belongings, and cancellation due to illness or unforeseen events. Insurance should explicitly cover travel in India and Himalayan regions, including activities such as yoga, hiking, and meditation. Proof of insurance may be required prior to departure. Failure to provide proof may result in cancellation of your booking with no refund. Sacred Journeys Ltd is not responsible for losses arising from failure to obtain suitable insurance.

 

8. HEALTH, SAFETY, AND MEDICAL DISCLOSURE

Participants must disclose all relevant medical conditions, medications, allergies, dietary requirements, or mental health concerns at the time of booking and update these details if they change before departure. This retreat involves yoga, meditation, breathwork, mountain travel, and exposure to altitude. You are responsible for assessing your personal fitness and ensuring that you are medically capable of participating safely. You may be asked to provide a medical clearance from your doctor. We reserve the right to deny participation in certain activities if deemed unsafe or inappropriate.

 

9. PHYSICAL AND ENVIRONMENTAL RISKS

By participating, you acknowledge and accept the inherent risks associated with: Trekking, hiking, and travel at elevation in the Himalayan region.

Uneven terrain, changing weather, and remote locations. Yoga, breathwork, and meditation practices involving physical exertion or emotional release.

Road travel and domestic transport within India. You accept full responsibility for your own health, safety, and personal wellbeing during the retreat.

 

10. ACCEPTANCE OF RISK

Participation in the Rishikesh & Himalayan retreat is voluntary. You understand and accept that injuries, illness, altitude-related symptoms, or accidents may occur despite appropriate precautions. By booking, you voluntarily assume all risks and agree not to hold Sacred Journeys Ltd or its facilitators liable for any injury, loss, or damage arising from participation in retreat activities, travel, or accommodation.

 

11. INDEMNITY AND WAIVER OF LIABILITY

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Soul Room Sacred Journeys Ltd, its employees, facilitators, and contractors from any claim, demand, or expense arising directly or indirectly from: Your participation in yoga, meditation, or breathwork practices;

Your participation in hikes, excursions, or cultural experiences; Any act, omission, or negligence by you during the retreat. You acknowledge that participation is entirely voluntary and at your own risk.

 

12. THIRD-PARTY PROVIDERS

Soul Room Sacred Journeys Ltd works with independent third-party providers including accommodation partners, transport operators, yoga studios, local guides, and facilitators. We do not own or control these entities and accept no responsibility for their acts or omissions. All services provided by third parties are subject to their own terms and conditions, which you agree to accept as a condition of participation.

 

13. PASSPORTS, VISAS, AND ENTRY REQUIREMENTS

You are solely responsible for ensuring you possess a valid passport and visa for entry into India. Your passport must be valid for at least six (6) months from your date of entry. We accept no liability for denied boarding, delayed visas, or additional costs resulting from incomplete documentation. It is your responsibility to obtain all necessary travel permissions.

 

14. EARLY RETURN, ILLNESS, OR NON-PARTICIPATION

If you leave the retreat early or miss scheduled activities for personal or medical reasons, no refund or credit will be issued. All expenses arising from early departure—including accommodation, meals, and travel—are your responsibility. Travel insurance should be arranged to cover such circumstances.

 

15. PROGRAM VARIATION

We reserve the right to modify or substitute facilitators, venues, or activities where necessary due to weather, safety, or availability. Substitutions do not entitle participants to refunds or compensation. All adjustments will be made with the intent of maintaining the retreat’s integrity and participant experience.

 

16. CULTURAL AND SPIRITUAL CONDUCT

This retreat takes place in Rishikesh and the Himalayan foothills, sacred regions regarded as the spiritual heart of yoga. Participants are expected to conduct themselves with respect for local customs, temples, and communities. You agree to act mindfully and courteously, refraining from behavior that could be considered disrespectful, unsafe, or disruptive. Soul Room Sacred Journeys Ltd reserves the right to remove any participant engaging in inappropriate or unsafe behavior without refund.

 

17. PRIVACY AND MEDIA CONSENT

Personal information collected by Soul Room Sacred Journeys Ltd is used solely for retreat management, communication, and safety purposes. Photography and video may be captured for promotional use. By attending, you consent to the use of your image and likeness by Soul Room Sacred Journeys Ltd for marketing and documentation purposes. You may opt out by notifying us in writing prior to the retreat.

 

18. GOVERNING LAW

These Terms and Conditions are governed by and interpreted under the laws of New Zealand, and any dispute will be subject to the exclusive jurisdiction of New Zealand courts.

 

19. SEVERABILITY

If any part of these Terms and Conditions is deemed invalid or unenforceable, the remaining clauses shall continue in full force and effect.

 

20. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between you and Soul Room Sacred Journeys Ltd. They supersede all prior communications, representations, or agreements, whether written or oral. Sacred Journeys Ltd reserves the right to update or amend these Terms by written notice, which will apply to all future bookings.

 

ACKNOWLEDGEMENT

By booking, paying a deposit, or attending the Rishikesh & Himalayan Yoga and Meditation Retreat, you confirm that you have read and understood these Terms and Conditions and voluntarily agree to be bound by them.
